| (1) | The Minister may require information from any person if the information is necessary for— |
| (a) | the administration and enforcement of this Act; and |
| (b) | compliance with the Convention. |
| (2) | The Minister may, by written notice served on any person, require that person to provide such information as may be necessary within the period and in the manner and form specified in the notice. |
| (3) | If a person, without reasonable excuse, refuses to provide the information in compliance with subsection (2), the Minister may apply to court for an order requiring the person to provide the information. |
| (4) | On hearing the application, the court may order the person to provide the information if the court concludes that, in the circumstances of the case, the production of the information is necessary to ensure South Africa's compliance with the Convention. |
