| (1) |
Any person who actively participates in or is a member of a criminal gang and who— |
| (a) |
wilfully aids and abets any criminal activity committed for the benefit of, at the direction of, or in association with any criminal gang; or |
| (b) |
threatens to commit, bring about or perform any act of violence or any criminal activity by a criminal gang or with the assistance of a criminal gang; |
| (c) |
threatens any specific person or persons in general, with retaliation in any manner or by any means whatsoever, in response to any act or alleged act of violence, |
shall be guilty of an offence.
| (b) |
incites, instigates, commands, aids, advises, encourages or procures any other person to commit, bring about, perform or participate in a pattern of criminal gang activity; or |
| (c) |
intentionally causes, encourages, recruits, incites, instigates, commands, aids or advises another person to join a criminal gang, |
shall be guilty of an offence.
