29. Management structure of treatment centre and halfway house

 

(1) A management structure must be established in accordance with the provisions of this section for each treatment centre and halfway house.

 

(2) The Minister must prescribe the—
(a) composition of the structure, which must include representatives of the beneficiaries of the service, staff of the relevant treatment centre or half way house and members of the public;
(b) election, appointment, qualification, terms of office and grounds for removal from office of members of the structure and the filling of vacancies; and

(c)        number of and procedure to be followed at meetings of a management structure.

 

(3) The management structure established in terms of subsection (1) must ensure that the treatment centre or halfway house—
(a) provide a quality service;
(b) provides opportunities for the training of staff;
(c) applies principles of sound financial management;
(d) if it is a treatment centre or a halfway house registered in terms of Non Profit Organisation Act, 1997 (Act No. 71 of 1997), comply with section 18 of that Act;
(e) if it is a company registered in terms Companies Act ,1973 (Act No. 61 of 1973), comply with section 302 of that Act; and

(f)        functions effectively.
