| (1) |
The Broad-Based Black Economic Empowerment Commission is hereby established as an entity within the administration of the Department. |
| (a) |
has jurisdiction throughout the Republic; |
| (b) |
must be impartial and perform its functions without fear, favour or prejudice; and |
| (c) |
must exercise the functions assigned to it in terms of this Act or any other law— |
| (i) |
in the most cost-effective and efficient manner; and |
| (ii) |
in accordance with the values and principles mentioned in section 195 of the Constitution; |
| (4) |
The Minister may issue directives of a general nature, which are consistent with this Act, to the Commission concerning the performance of its functions and the Commission must comply with any such directive. |
| (5) |
Each organ of state must assist the Commission to exercise its authority and perform its functions effectively. |
