"spouse"
means a person who is a party to-
| (a) | a marriage as defined in terms of this Act; or |
| (b) | a permanent homosexual or heterosexual relationship as prescribed; |
means a person who is a party to-
| (a) | a marriage as defined in terms of this Act; or |
| (b) | a permanent homosexual or heterosexual relationship as prescribed; |
