Limitation on the Abstraction and Use of Water for Irrigation purposes

Notice in terms of Section 72(1) read with item 6 of Schedule 3 of the National Water Act

 

Limitation on the Abstraction and Use of Water for Irrigation purposes in the Lower Riet River and its tributary the Modder River downstream of the Krugersdrift Dam to the confluence of the Riet River with the Vaal River: Districts Boshof, Kimberley, Petrusburg, Jacobsdal and Herbert

 

By virtue of the powers vested in me by section 72(1) read with item 6 of Schedule 3 of the National Water Act, 36 of 1998:

 

1) I, Kader Asmal, in my capacity as Minister of Water Affairs and Forestry, hereby declare that a water shortage is being experienced in the area mentioned below.

 

2) I, direct, with regard to the whole area downstream of the Krugersdrift dam, including the Modder River and the Lower Riet River, down to the confluence of the Riet and Vaal Rivers, that the following restriction of water for irrigation purposes shall apply:

 

2.1) Abstraction for irrigation purposes within the Riet River and its tributary the Modder River downstream of the Krugersdrift dam, (including the Scholtzburg and Lower Riet River Irrigation Districts) must be curtailed to 35% of the full quota delivered from the Krugersdrift Dam.

 

3) I hereby assign in terms of section 75(1)(b) of the said Act, to the Regional Director: Free State and the Regional Director: Northern Cape, Department of Water Affairs and Forestry the power to, by notice in the Government Gazette—

 

3.1) amend with their discretion the provisions of this notice in general or in respect on any particular area or person in order to accomplish, with due regard to local conditions, the required curtailment; or
3.2) with due regard to a deterioration or improvement in the availability of water in the Krugersdrift dam—
a) extend or relax the envisaged curtailment or, as the case may be, to lift it indefinitely, in which case this notice shall be deemed to have been revoked by me; or
b) temporarily take over the operation of and privately owned water works by means of which water to which this notice applies, is abstracted, impounded, stored, supplied or used for irrigation purposes and to cause the operation of such a water work to be undertaken in accordance with their directions by any person designated in writing by them.
