Chapter 26 : Competent Verdicts

259. Culpable homicide

 

If the evidence on a charge of culpable homicide does not prove the offence of culpable homicide, but—

(a) the offence of assault with intent to do grievous bodily harm;
(b) the offence of robbery;
(c) in the case relating to a child, the offence of exposing an infant, whether under a statute or at common law, or the offence of disposing of the body of a child, in contravention of section 113 of the General Law Amendment Act, 1935 (Act No.  46 of 1935), with intent to conceal the fact of its birth;
(d) the offence of common assault;
(e) the offence of public violence; or
(f) the offence of pointing a fire-arm, air-gun or air-pistol in contravention of any law,

the accused may be found guilty of the offence so proved.
